Terms of Service

The Service is a free, fan-operated web application that provides utilities for players of the third-party game "Creatures of Sonaria," including the ability to generate visual trading card assets, browse publicly available item data, and perform approximate value calculations. The Service is provided for informational and entertainment purposes only.

We make no representation that the item data, values, or any other information provided through the Service is accurate, complete, current, or suitable for any particular purpose. All data is sourced from publicly available third-party resources and is presented without verification or endorsement. You assume all risk associated with reliance on any information obtained through the Service.

The Service, or any feature or component thereof, may be modified, suspended, or permanently discontinued at any time without notice and without liability to you or any third party.

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms and all applicable local, national, and international laws and regulations. You further agree not to use the Service in any way that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service.

Without limiting the foregoing, you expressly agree not to: (a) attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service; (b) use automated means, including scrapers, bots, crawlers, or similar tools, to access, harvest, or collect data from the Service in a volume or manner that disrupts normal operation; (c) exploit, abuse, or misuse any infrastructure component of the Service for purposes outside its intended function; (d) use any content generated by the Service to deceive, defraud, or mislead other users or third parties; (e) represent the Service or any content generated thereby as an official product of any third-party game developer or publisher; or (f) engage in any conduct that we, in our sole discretion, deem harmful to the Service, its users, or any third party.

All original code, design, and content constituting the Service are the intellectual property of CoS Trading Cards and are protected by applicable copyright and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in or to the Service beyond the limited right to access and use it in accordance with these Terms.

The Service displays game assets, item names, images, and other content that are the intellectual property of their respective owners. We make no claim of ownership over any third-party content displayed through the Service. Such content is displayed solely for the purpose of enabling the Service's fan utility functions and is not used for commercial gain.

If you are a rights holder and believe that content displayed through the Service infringes your intellectual property rights, please contact us via Discord at @vororblx with sufficient detail to identify the allegedly infringing material, and we will take appropriate action.

The Service may enable you to generate image assets ("Generated Content") based on data and templates provided by the Service. You retain all rights in any original elements you contribute to such Generated Content. By using the Service to generate and share such content, you represent and warrant that your use does not infringe the rights of any third party and is consistent with these Terms.

We do not claim any ownership interest in Generated Content. We do not store Generated Content on our servers; all Generated Content is retained solely on your local device. We are not responsible for any use you make of Generated Content beyond the Service.

The Service interoperates with various third-party platforms and services to deliver its functionality. Your use of the Service may cause your device to establish connections with such third-party systems. We are not responsible for the availability, accuracy, content, or practices of any third-party service, and we make no warranties or representations regarding any third party.

Links or references to third-party resources, if any, are provided solely for convenience and do not constitute an endorsement or recommendation by us. Your interactions with any third-party service are governed solely by the terms and privacy policies of that third party.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, NOR THAT ANY DEFECTS WILL BE CORRECTED.

WE EXPRESSLY DISCLAIM ANY AND ALL LIABILITY FOR ANY LOSS OR DAMAGE, WHETHER IN-GAME, FINANCIAL, OR OTHERWISE, ARISING FROM YOUR RELIANCE ON ANY INFORMATION, CONTENT, OR FUNCTIONALITY PROVIDED BY OR THROUGH THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CoS TRADING CARDS, ITS OPERATORS, OR ITS AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold harmless CoS Trading Cards and its operators from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right; or (d) any claim that your use of the Service caused damage to a third party.

We reserve the right to modify these Terms at any time in our sole discretion. Updated Terms will be posted to the Service with a revised effective date. Your continued use of the Service following the posting of any modifications constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms periodically for changes.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation between the parties. If such negotiation fails to resolve the dispute, the parties agree to submit to binding arbitration or the jurisdiction of courts of competent authority, as applicable.

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect. The failure of either party to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us with respect to your use of the Service and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Service.
